Welcome to Scoops and Loops LLC. ("company", "we", "us", or "our"). These Terms and Conditions ("Terms") govern your use of our website located at www.scoops-and-loops.com (the "Site") and purchase of our products.

By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.

1. Orders and Pre-Orders

Order Acceptance: All orders placed through our Site are subject to availability and acceptance. We reserve the right to refuse or cancel any order at any time for reasons including product availability, errors in pricing or product descriptions, or suspected fraud.
Pre-Orders and Custom Orders: Pre-orders require payment in full (or an agreed upon deposit) at the time of order placement to reserve your baking slot. Pre-Order pickup (or delivery if discussed) are an estimate and subject to minor adjustments with prior notice.
Modifications: Changes to existing orders or pre-orders must be requested at least 48 hours prior to the scheduled pickup/delivery date. We will make reasonable efforts to accommodate modifications or time exemptions, but cannot guarantee changes after an order is confirmed.

2. Pricing and Payment

Pricing: All Prices listed on the Site are in USD and are subject to change without notice. Prices do not include applicable sales tax, which will be added at checkout.
Payment Processing: Payment must be made at the time of purchase via our secure online payment portal. We accept major credit cards and other online payment methods indicated at checkout.

3. Pickup, Delivery, and Shipping

Local Pickup: Customers selecting local pickup are responsible for arriving during designated pickup hours at Scoops and Loops LLC./404 Main Ave, Brookings, South Dakota 57006, USA. Orders not picked up within 24 hours of the scheduled window may be forfeited without refund due to the perishable nature of our goods.
Local Delivery: This option is not available at this time.
Shipping: This option is not available at this time.

4. Cancellations and Refunds

Standard Orders: All Sales are Final. No refunds will be given due to the perishable nature of our goods. If a quality or major issue arises contact us immediately with a picture of the issue, so we can deal with the situation as we see fit.
Custom Orders & Large Pre-Orders: a 50% Deposit or payment for custom orders, seasonal pre-orders are non-refundable. Payments within 5 days of the fulfillment date, as specialty ingredients and scheduling have already been allocated may be entitled to a 50% store credit of the purchase cost. All refunds are up to the stores discretion based on specialty ingredients, order size, quality concerns and pickup date.
Quality Concerns: If you are unsatisfied with the quality of your order, please contact us within 24 hours of the pickup time with photos and details. We handle quality claims on a case-by-case basis and may offer a replacement, partial credit, or refund at our sole discretion

5. Food Allergen and Ingredient Disclaimer

Allergen Notice: Our products are prepared in a kitchen that processes common food allergens, including but not limited to; Wheat/Gluten, Dairy, Eggs, Soy, Peanuts, and Tree Nuts.
Cross-Contamination: While we follow strict sanitization and handling procedures (including dedicated precautions for gluten-free or special dietary items), we cannot guarantee that any item is 100% free from trace cross-contamination.
Customer Responsibility: Customers with severe food allergies must exercise their own judgement when purchasing and consuming our products.

6. Intellectual Property

All content on this Site - including text, graphics, logos, photos, product names, and recipe descriptions - is the property of Scoops and Loops LLC. or an agreed upon partner is protected by copyright and intellectual property laws. You may not reproduce, distribute, or modify any content without our express written premission.

7. Limitation of Liability

To the fullest extent permitted by law, Scoops and Loops LLC. shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Site or consumption of our products. Our maximum total liability for any claims arising out of your purchase shall not exceed the total amount paid by you for the specific order in question.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the state of SOUTH DAKOTA, without regard to its conflict of law principles.
